These "General Terms and Conditions" govern the use of the accommodation and services of the Service Provider. These General Terms and Conditions are the terms and conditions under which the operator, service provider Viva Velence Termálpart -1212 Budapest, Határ u. 92., hereinafter referred to as the Service Provider, concludes accommodation contracts with the persons, contracting parties, using other accommodation services.

Contracting parties

Customer: a person who uses the services of the accommodation and purchases the services in writing through the website or through the Service Provider's e-mail address info@vivavelence.hu, who acknowledges and accepts the GTC and accepts them as binding upon him/her, hereinafter referred to as the Guest

1. Purpose of the General Terms and Conditions

The General Terms and Conditions (GTC) contain the general terms and conditions of the legal relationship between the Service Provider and the Guest entering into a contractual relationship with the Service Provider. With regard to issues not regulated herein, the Hungarian legislation and official regulations in force at the time and the provisions of the Civil Code shall apply to the activities of the Service Provider without any special stipulation.

2. Acceptance of the Terms and Conditions

The acceptance of the Terms and Conditions by the Guest is a prerequisite for the purchase or use of the service. Acceptance of the Terms and Conditions is deemed to be acceptance if the Guest uses the service provided by the Service Provider.

3. Scope of the Terms and Conditions

The Service Provider reserves the right to modify these Terms and Conditions, in whole or in part, at any time. The GTC shall remain in force for as long as the Service Provider provides the service. These GTC are in force from 17 August 2015 for an indefinite period.

4. Territorial scope of the service

The service operated by the provider can be accessed from both national and international locations.

5. Contractual concepts:

Customer: a person who uses the services of the accommodation and purchases services through the website, who acknowledges and accepts the GTC and accepts them as binding upon him/herself, hereinafter referred to as the Guest.
Service Provider: Viva Venice, hereinafter referred to as "Service Provider", providing other temporary accommodation services in accordance with the terms and conditions of these GTC.
Service: other temporary accommodation service
Price quotation: the written quotation of the Service Provider in response to the Guest's oral or written request for a quotation.
Reservation: Reservation is the written confirmation of the Guest's written reservation sent by the Service Provider, which includes the subject, location, duration and price of the service, as well as the information required to finalise the reservation, including the payment of 50% of the total accommodation cost.Booking finalisation, validation:
Payment of the 50% specified in the reservation to secure the reservation.
The Reservation is concluded upon payment of the 50% and is therefore a written Contract and constitutes automatic acceptance of the GTC and the Booking and Cancellation Conditions.
Payment and Cancellation Conditions:
Setting out the conditions for payment of the consideration for the service provided by Viva Velence, the method of booking and payment, the timetable, the cancellation of the booking and the non-refundable amount in the event of cancellation.
Bank transfer:
Viva Velence accepts bank transfer or SZÉP card payment as a financial settlement.
Territorial scope of the service
The service operated by the Service Provider is available from both domestic and international locations.

6. The Service Provider provides the Service under the following conditions:

6.1 The apartment of the accommodation is available for rent for families, groups of friends. Maximum number of persons: 4. Smaller groups are possible by prior arrangement.

6.2. The equipment and facilities of the accommodation, for your careful use, are at your disposal during your stay.

6.3 We will do our utmost to ensure the safety of our guests and to draw their attention to possible sources of danger, but we cannot accept any responsibility for their personal belongings in the house or in the free parking area, or for personal injuries or damage to the house or its surroundings resulting from improper use. You will be liable to pay compensation for any damage caused by you to the house, its furnishings and surroundings.

6.4 In the event of a problem, we can be contacted on the website or at the telephone number or e-mail address given in these GTC to assist you during your stay, but we cannot accept any complaints after you have left.

7. How to request a quote or make a reservation:

7.1.The Service Provider shall send a quotation to the Guest's request for a quotation sent orally or in writing. The quotation may be amended by mutual written agreement. In the absence of a response to the quotation, the quotation will be cancelled after a 4 day grace period.

7.2 The booking is concluded upon written confirmation of the Guest's booking by the Service Provider, after payment of 50% of the total accommodation cost, and is thus considered as a written Contract and constitutes automatic acceptance of the Booking and Cancellation Conditions and the GTC. The Guest accepts that the deposit paid in advance for the reservation cancelled by him/her at the time of validation of the reservation will not be refunded to the Guest by the Service Provider.

7.5 Any modification or amendment of the Contract shall require the written agreement of the parties.
Any change to a booking already finalised and confirmed may be rescheduled to another date or the number of participants may be amended subject to availability.

7.6 The Service Provider's guesthouse is free to change its advertised prices without prior notice, except where it is not committed to a specific period.

7.7 The prices include the statutory rate of value added tax (VAT) in force at the time of the offer, which is currently 5%.

7.8 The local tourist tax is payable on the spot on a Guest per night basis in addition to the accommodation fee. The tourist tax is payable by persons aged 18-70.

7.9. The services advertised are used at the Guest's own risk.

7.10. No refund of money for services booked but not used or modified during the Guest's stay at the accommodation (accommodation, mediated services) is possible.

8. Modification or cancellation of the Service

8.1. Price offer:

The Service Provider will send a quotation to the Customer's request for a quotation, either orally or in writing. The quotation may be amended by mutual written agreement. In the absence of a response to the quotation, the quotation will be cancelled after a 4 day grace period.

8.2. Booking

8.2.1.If the minimum 50% required by the Service Provider to confirm the reservation is not paid by the agreed deadline, the reservation will be cancelled. A reservation, agreement, modification or verbal confirmation of a reservation, agreement, modification or verbal confirmation by the Service Provider shall not be deemed to be a contract. Any modification or amendment of the reservation shall require the written agreement of the parties.

8.2.2.2 It is possible to reschedule a confirmed booking to another date or to change the number of guests, subject to availability.

8.2.3 The Service Provider's guesthouse is free to change its advertised prices without prior notice, except where it is not committed to do so for a specific period..

9. Conditions for claiming:

9.1 The guest can check-in until 16.00-18.00 on the day of occupancy. Check-out is until 10.00 a.m. on the last day of the stay. The check-out time may be extended by prior arrangement.

9.2 Upon arrival at the accommodation, the Guest is required to prove his/her identity in accordance with the legislation in force before checking in. By completing and signing the registration form, the Guest accepts the General Terms and Conditions of the accommodation and the posted Rules of the accommodation.

9.3 The Accommodation shall not be liable for any damage caused by the Guest. The costs of damage shall be borne by the Guest.

9.4 For reasons of hygiene and in view of the increasing number of allergies, pets are NOT allowed in the accommodation.

9.5 Smoking is prohibited in the house.

10. Refusal to use accommodation, termination of contract.

10.1 The Accommodation shall have the right to terminate the contract and refuse to provide the service if the Guest 1. fails to make payment.
2. the Guest does not make proper use of the accommodation
3. suffers from a communicable disease
4. is under the influence of drugs
5. engages in unacceptable, immoral, violent or incompatible behaviour in the accommodation and its surroundings.
6. in the event of causes beyond the control of the parties, so-called Vis Major (war, fire, flood, adverse weather conditions, power failure, strike), over which the party has no control

7. Failure by the Guest to comply with its obligation to provide information.

 

11. Rights of the Guest

1. The Guest is entitled to use the Accommodation for its intended purpose within the scope of the services,
2. The Guest is entitled to use the equipment and facilities of the accommodation.
3. In case of any problem during the stay, the service provider can be contacted by phone or in writing at info@vivavelence.hu to solve the problem as soon as possible.

4. The Guest's right to lodge a complaint ceases after leaving the accommodation.

 

12. Obligations of the Guest

12.1 The Guest shall pay for the Services by the time and in the manner specified in the Contract.
12.2. ensure that children under the age of 18 under their supervision are only under the supervision of an adult.

12.3. Guest is obliged to compensate the service provider for any damage caused by him or his companion or persons under his supervision.

13. Rights of the Service Provider

13.1 The Service Provider shall be entitled to retain the minimum 50% of the accommodation costs received for the accommodation service ordered and finalised by the Guest but not used by the Guest, as set out in these GTC and in the Booking and Cancellation Conditions.
13.1.2 The Service Provider shall have the right to refuse or terminate the accommodation service in the event of the provisions of clauses

14. Liability of the Service Provider

14.1.. The Service Provider is obliged to investigate the guest's complaint during the stay and take the necessary steps to address the problem.
14.2. The Service Provider is obliged to provide the Guest with his/her telephone contact details in order to resolve any problems or questions that may arise during the stay.
14.3. The Service Provider is not responsible for any electrical equipment brought in by the guest, and the guest is responsible for any damage caused by the equipment.
14.4. The Service Provider shall not be liable for damage caused by the guest or for damage caused by the guest's own fault or by damage beyond the control of the guest.
14.5. The Service Provider shall not be liable for personal belongings, valuables, cash left in the common areas or rooms of the Service Provider.
14.6. The Service Provider shall not be liable for valuables left in the Service Provider's free, fenced parking lot.

15. Payment and Cancellation Conditions

15.1. The reservation is valid upon acceptance of the Booking and Cancellation Conditions and the ASZF, upon payment in advance of 50 % of the total accommodation price and its confirmation. If the requested amount has not been received by the indicated deadline, the Service Provider's obligation to offer and provide the service shall be terminated.
15.2. Payment of the 50% can be made by bank transfer, online with OTP or MBH Nice Card and credit card. The remaining amount is payable in cash or by OTP or MBH Prepaid Card on receipt of the keys. In case of cancellation, 50 % of the deposit will not be refunded.
15.3. The costs related to the use of any payment method shall be borne by the Contracting Guest or his/her SZÉP card/bank card.

16. Obligation and responsibility of the service provider:

16.1. The Service Provider shall provide the Service to the Guest on an ongoing basis against payment of the Guest's payment obligation.
16.2. The Service Provider shall not be liable for any damage caused by force majeure, force majeure or any other cause or event beyond the Service Provider's control, for which the Service Provider cannot be held liable.
16.3. The Service Provider reserves the right to change prices. We are not responsible for any errors on the site. The price includes the applicable taxes and the General Sales Tax (VAT) corresponding to the service, with the exception of the tourist tax per person per night.
16.4. The Service Provider shall store the Customer's data for the purpose of fulfilling the contract and subsequent proof of the terms of the contract, but shall not be entitled to pass them on for advertising or any other purpose without the Customer's express consent.
16.5. Handling guest notifications and complaints
The Customer may report any errors detected in connection with the above banking services to the Service Provider in person, by telephone, or by e-mail at info@vivavelence.hu. The Service Provider shall investigate the reports and complaints within 30 days and shall inform the Customer of the results of the investigation in accordance with the method of reporting. The Service Provider shall keep a record of the reports and complaints. The Service Provider shall take immediate action to correct any defect reported by the Guest which is found to be true as a result of the investigation and which is in the interest of the Service Provider.

17. Rights and obligations of the Guest

17.1. The guest must fill in the website with the exact details before starting the payment by credit card in order to avoid any problems.
17.2. We shall not be liable in any way for any incorrect information provided by the Guest and for any damages resulting from incorrect information, including any damages resulting from incorrect performance.
17.3. The Guest is obliged to pay for the service by bank transfer or SZÉP card payment method. The Guest may deviate from the chosen payment method only with the prior consent of the Service Provider. If the Guest is unable to pay the purchase price of the ordered service, the ordered service will be automatically deleted from the system.

Data protection

The Service Provider attaches importance to the protection of personal data and takes all security, technical and organizational measures to guarantee the security of the data, and stores the guest data only until the day of check-out.
In fulfilling its obligations under the Contract, the Service Provider shall comply with the provisions of the applicable legislation on the protection of personal data and the disclosure of data of public interest (currently: Act LXIII of 1992 and Act CXII of 2011 on the Right to Information Self-Determination and Freedom of Information).
The Guest acknowledges that the Service Provider is obliged by law to provide the requesting authority with the data required by law.

The Service Provider shall publish its data protection principles in a separate Data Protection Statement on its website.
